Contest Rules
NO PURCHASE NECESSARY TO ENTER. VOID WHERE PROHIBITED BY LAW.
- 1. Who Can Enter:
Any legal resident of the fifty (50) United Sates (and the District of Columbia) excluding Puerto Rico and all territories and possessions of the United States and overseas military installations, who are between eighteen (18) years of age and thirty-five (35) years of age at time of entry are eligible to participate in the One Life. One Shot Photo Contest (“Contest”). Employees, officers, principles, directors or agents of Contiki U.S. Holdings, Inc. (“Contiki”), and their respective subsidiaries or affiliates, and members of their households or immediate families, are not eligible to participate. The contest is subject to all applicable federal, state, local and provincial laws and regulations, and shall be void where prohibited by law.
- 2. How to Enter:
To enter the Contest, visit website (www.contiki.com/contests/one-life-one-shot), complete the online entry form in its entirety, upload a travel photo that meets the below requirements, and check the box to agree to accept the terms of the Official Rules. The online entry form must be submitted between 8:00:00 a.m. PST on December 3, 2012 (“Contest Open Time”) and 4:00:00 p.m. PST on December 21, 2012 (“Contest Close Time”). All submitted photos must be either your own work or submitted with the consent of the photographer/creator and identified as such. By submitting a photo you are granting Contiki ongoing usage rights. In exchange for the use of the photo Contiki will pay $50 for each image selected. All submissions selected for usage will be notified and the person who submitted the photo will be issued $50. By paying $50 Contiki is not guaranteeing the image will be used. Contiki assumes no responsibility for any lost, stolen, delayed, damaged or misdirected $50 payments regardless of the circumstances. All submitted photos will be moderated by an official Contiki administrator. Images that are deemed vulgar, unlawful, harmful, obscene or generally inappropriate will not be approved by the administrator and your submission will not be entered in the Contest. It is your responsibility to ensure that your submitted photo does not infringe the intellectual property rights or other rights of any third party, or any laws. Written consent must be given for any persons identified in the photos submitted. Contiki’s clock will be the official time-keeping device for the Contest. No written or mailed entries will be accepted. Any entry forms that are illegible, incomplete, or late will be disqualified.
Unlimited entries per person, per email address allowed between Contest Open Time and Contest Close Time. Contiki reserves the right in their sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Contest or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person. Contiki reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
- 3. Contest Dates:
The Contest will begin at the time the Contest Open Time and end exactly at the Contest Close Time.
- 4. Intellectual Property:
Entrants, upon submission of their entry to the Contest, hereby irrevocably grant to Contiki and each of their licensees, successors and assigns, the non-exclusive, perpetual, royalty-free, no-cost license and right to use and otherwise exploit the entry submitted as part of the Contest, and all images, text and materials depicted therein, in whole or in part, in any manner or medium now or hereafter known or devised (including, without limitation, CDs, streaming media, film, television, videocassettes, print, interactive devices, mobile media, Internet and online systems), throughout the universe and in any and all languages, including, without limitation, the right to display, reproduce, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title and adapt the same, to combine it with other material and otherwise use and exploit it. Contiki, and each of their successors, assigns and licensees, will have the right to make unlimited derivative works therefrom, to assign or transfer any or all such rights and to grant unlimited, multiple-level sublicenses. Without limiting the forgoing, Contiki will have the right to use the entries submitted as part of the Contest, and all images depicted therein (if any), in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose. Entrants hereby forever waive and relinquish all so-called “moral rights” now or hereafter recognized in connection with entries submitted as part of the Contest. Entrants agree that Contiki shall have the sole discretion in determining the extent and manner of use of entries and are not obligated to use any entry. Entrants agree not to issue any publicity concerning Contiki. Entrants agree that neither Contiki nor their agents shall be responsible for returning or preservation of the entries submitted. All entries that are posted on Contiki’s website(s) may be available to be viewed by anyone with access to the Internet. Entrant images become the property of Contiki and can be used on the respective website(s); store signage, blog(s), Facebook page(s) and for any other marketing purpose.
- 5. Prizes:
A minimum of three (3) and maximum of five (5) winners will be chosen and awarded by Contiki for the best photo submissions. Contiki will only award photo submissions that meet a high-quality standard as determined by Contiki in their sole and absolute discretion. The winning entrants will receive $500 each. The total Contest prizing has an approximate retail value that will not exceed $2,500.00. Should the value of the prizing be less than the ARV, the difference will not be awarded in cash or in kind.
- 6. Selection of Winner:
A minimum of three (3) and maximum of five (5) winners will be selected by Contiki based on eligible entries property submitted between the Contest Open Time and Contest Close Time. Contiki will only award photo submissions that meet a high-quality standard as determined by Contiki in their sole and absolute discretion. If the photos submitted by Contest Close Time do not meet Contiki’s high-quality standard requirement, three (3) winners will be awarded instead of five (5). The awarding of the prizes for the Contest will be held at 801 E. Katella Ave. Anaheim, CA 92805 on or about 4:00:00 p.m. PST on January 2, 2013.
- 7. Odds of Winning:
Each entrant’s odds of winning are dependent on the aggregate number of eligible entries properly submitted between the Contest Open Time and the Contest Close Time. No purchase of any kind is necessary in order to enter the Contest or win any prize, and chances of winning are not enhanced by making any purchases.
- 8. Winner Notification:
The winners will be notified by Contiki, via e-mail, at the contact information provided at the time of entry by January 15, 2013. The winners will be required to respond to the e-mail notification to acknowledge receipt of Contiki’s notification and awarding of the prize. If no response is received by Contiki from the winner(s) within 48 hours after initial contact, the winner(s) will forfeit their prize and there will be no replacement winner(s). All decisions of Contiki regarding the winners are final, binding and non-appealable. Contiki is not responsible for any incorrect or illegible address information or the non-delivery of any prize resulting there from, or for any unsuccessful efforts to notify a winner. It is the sole responsibility of the entrant to notify the Contiki by mail if the entrant changes his/her email address. (To do so, send notification to: 801 E. Katella Ave. Anaheim, CA 92805. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized accountholder of the e-mail account.
- 9. Limits of Liability:
Entrant acknowledges and agrees that Contiki has no responsibility whatsoever for injuries, losses, or damages of any kind that result from entrance into the Contest or receipt, acceptance, possession, or use of any prize. Contiki assume no liability for lost, late, illegible, misdirected, mutilated, incomplete, incorrect, or inaccurate entries forms regardless of the circumstances.
Contiki reserve the right to cancel the Contest at any time if the integrity of the Contest is, in Contiki’s sole and absolute discretion, compromised in any way. By entering the Contest, entrants release and hold Contiki harmless from and against any and all damages and claims of any kind in connection with the Contest or resulting from entrance in the Contest, or receipt, acceptance, possession or use of any prize. Contiki reserves the right to substitute a prize for an alternative prize of equal or greater value in Contiki’s sole and absolute discretion.
All entries become the sole property of Contiki, and Contiki assumes no responsibility for any lost, stolen, delayed, damaged or misdirected entries. Contiki reserve the right, in their sole discretion, to cancel or suspend the Contest should cause beyond the reasonable control of Contiki corrupt the security or proper administration of the Contest. Any attempt to deliberately damage the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Contiki reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California, County of Orange. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of Contiki in connection with the Contest, shall be governed by, and construed in accordance with, the laws of State of California, County of Orange, without giving effect to any choice of law or conflict of law rules (whether of the State of California, County of Orange or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of California, County of Orange.
- 10. Winner Responsibilities:
Entry into the Contest shall be deemed to be entrant’s consent and authorization to (i) the use of entrant’s name, address (city and state only) and any other information submitted by entrant for commercial, advertising and promotional purposes in perpetuity without further compensation, unless prohibited by law, and (ii) the use of entrant’s address to receive marketing and other emails from Contiki and their affiliates. In addition, by entering the Contest, entrants affirm that they have read, understood and accepted these Official Rules.
- 11. Winner Publicity:
Contiki may publish the first name, last name, location (city/state), and winning photo of the winners on the websites located at: http://www.contiki.com/ or http://blog.contiki.com/. To obtain the winners’ names, send a self-addressed, stamped envelope to: Contiki Marketing, 801 E. Katella Ave., Anaheim, CA 92805.
- 12. Official Rules:

- 13. General:
This Contest is subject to all applicable federal and state laws and regulations. By entering the Contest participants agree to be bound by these Official Rules and by the decision of Contiki, which shall be final on all matters relating to this Contest. This Contest shall be void where prohibited by law.
